Terms and conditions
1 General
1.1 This web site (the "Site") is owned and operated by LondonNetMail (the trading name of Camberwell Services). LondonNetMail provides computing and information services (the "Services") to those persons ("the members") who utilise its service. These services are provided to you on the basis that you accept the terms of this contract which are stated below. This is a legal agreement and it sets out your rights and obligations and those of LondonNetMail. By completing the registration process and clicking the 'SUBMIT' button you are confirming your agreement to be bound by these terms and conditions. You must adhere to these Terms and Conditions for so long as you continue to use the services. If these terms and conditions are not accepted in full you do not have permission to access this Site and therefore should cease using the Site immediately.
2 Description of the Service
2.1 LondonNetMail provides an extensive range of domain names ("post offices") which give you the ability to create your own email address ("mailbox") e.g. yourname@youraddress.com. You may use the mailbox you have selected to send and receive electronic mail ("email") using the Internet and the email messaging services of LondonNetMail.
3 The Provision of the Service
3.1 LondonNetMail will allow each member to register one mailbox using any available name of his or her choice under any available post office and will charge an annual membership fee for this service. This membership fee may be varied at any time at the discretion of LondonNetMail. No member has exclusive rights over any domain name which remains the property of LondonNetMail but will have exclusive rights to use this mailbox for email messaging purposes for such time as their membership remains valid. Each member must provide their own access to the Internet and pay any telephone and connection charges associated with such access.
3.2 In consideration each member agrees to provide accurate current and complete information in the registration process and to maintain and update the information at renewal of membership. Each member grants LondonNetMail the right to disclose to third parties certain information provided by the member subject to LondonNetMails Privacy Promise. If any information provided by the member is false or inaccurate LondonNetMail retains the right to terminate the member's membership and rights to use the service.
4 Use of the Service
4.1 Each member's right to use the service is personal to that member and no member may resell or make any commercial or business use of the service (without the express prior consent of LondonNetMail). In particular no member should abuse the service or use it for any illegal purpose. The definition of abuse is at the sole discretion of LondonNetMail.
5 Spamming
5.1 The sending any form of e-mail that can be interpreted as junk e-mail or bulk e-mail that the recipient has not specifically requested ("spamming") is prohibited. LondonNetMail or its affiliates will determine in their sole discretion whether any of the messages you send are spam. We reserve the right to take legal and technical remedies to prevent you from sending spam. If you send any spam we may penalize you by terminating the Services and through any other remedies we may have available to us.
6 Member Password and Security
6.1 Each member will receive a password on registering for the service. It is the responsibility of each member to maintain the confidentiality of that password and members are entirely responsible for any activity which takes place under any of the addresses registered in their name. If any member becomes aware of any unauthorised use of any of its registered names and addresses or any breach of security that member should notify LondonNetMail immediately.
7 Intellectual Property Rights
7.1 All the domain names available for use on the service are the sole property of LondonNetMail and may not be used for any commercial use without the express consent of LondonNetMail. Each member acknowledges that the content of the Site which includes but is not limited to text software and graphics is protected by copyright and members are not entitled to copy or reproduce or distribute any of the content without the express permission of LondonNetMail. Each member acknowledges that in addition to copyright there are also trademarks and other intellectual property rights in and relating to the service which are owned by LondonNetMail or its affiliates and which are not to be used without express permission.
8 Disclaimer of Warranties
8.1 LondonNetMail does not warrant that the service will meet any particular requirements of the member or that the service will be uninterrupted or that that emails will be sent or received within any particular time or that the service will be secure or error free. LondonNetMail does not give any warranty in respect of any goods or services purchased or obtained through the service or any transactions entered into through the service. LondonNetMail shall have no obligation to maintain any content in your account or to forward any unread or unsent messages to you or any third party. LondonNetMail may terminate your access to any part or all of the Service and any related service(s) at any time with or without cause with or without notice effective immediately for any reason whatsoever. If your mailbox is cancelled by you or by us all email including any attachments will automatically be deleted.
9 Limitation of Liability
9.1 Each member agrees that he or she uses the service at his or her own risk. LondonNetMail or its subsidiaries affiliates officers and employees will not accept any liability either in contract tort (including negligence) or otherwise for any direct indirect incidental or consequential loss resulting from the use or the inability to use the service. Nothing in these terms and conditions limits LondonNetMails liability for death or personal injury resulting from LondonNetMails negligence. Each member agrees that that any material and/or data downloaded by a member is done so entirely at their own risk and each member will be solely responsible for the consequences of downloading any such material.
10 Indemnity
10.1 Each member agrees to indemnify LondonNetMail against all liabilities claims and expenses that may arise from any breach by them of these terms and conditions and any liabilities claims and expenses incurred by LondonNetMail in connection with any claim action or proceeding brought by a third party as a result of the members use of the service.
11 Severability
11.1 If any of the provisions of this contract is judged to be illegal unreasonable or unenforceable the rest of these terms and conditions will continue to apply. Any delay on the part of LondonNetMail to enforce its rights under this contract will not prejudice or restrict its rights and no waiver of any such rights will be deemed to be a waiver of any other right or of any later breach.
12 Notices
12.1 Any notices sent pursuant to this agreement will be effective if sent by email to the members primary LondonNetMail email address 24 hours from the time of sending.
13 Applicable Law
13.1 These terms and conditions will be governed in accordance with the laws of England and Wales. Each member and LondonNetMail agree to submit to the exclusive jurisdiction of the courts of England and Wales.
